LinguaTute's Terms And Conditions
LinguaTute provides a service of introducing Tutors to Clients, and Clients to Tutors, for the purpose of delivering language and language-related educational support. LinguaTute also hosts online courses to provide further foreign language and literature support.
By purchasing any educational support service through LinguaTute, the Client agrees to be bound by these terms and conditions.
These terms and conditions are legally binding – every Client should read and understand them fully before agreeing to them.
2. LinguaTute’s Rights and Responsibilities
To introduce Clients to Tutors, and Tutors to Clients; facilitate booking and payment of lessons; advertise the Tutor through the Company’s platforms, including the Website and any relevant social media platforms; provide language-learning resources and opportunities, including online workshops, masterclasses, courses, webinars, blog articles, and educational videos.
3. Student Responsibilities
a. LinguaTute is not responsible for the acts or omissions of Students or Tutors and is solely responsible for its own acts or omissions.
b. Students must be at least 18 years old to book a Tutor for themselves. Students under the age of 18 must be represented by a parent or legal guardian who gives consent for them to receive tuition from a Tutor via LinguaTute. LinguaTute is not responsible for any dispute between a person under the age of 18 and a parent or guardian.
4. Tutor Status and Responsibilities
a. Tutors are not employees of LinguaTute and are solely responsible for their own actions both on and off the Website.
b. Tutors must be at least 18 years old.
c. Tutors must be legally entitled to work in the UK on a self-employed basis.
d. If Tutors contact Students who are under 18, they must ensure that these Students are represented by a parent or legal guardian who gives consent for the Student to receive tuition.
e. Tutors are responsible for ensuring that the personal information they provide and their tutor profiles on the Website are accurate and in no way misleading. They must update this information promptly to maintain its accuracy.
f. Tutors must disclose any criminal convictions or cautions they may have to LinguaTute, including any criminal convictions or cautions received at any time after having registered as a tutor with LinguaTute and for as long as the Tutor remains under contract with LinguaTute.
a. LinguaTute accepts payment via Tutorcruncher. Once a Client enters their card details for the first invoice, the card details will be saved and automatically charged for all completed lessons henceforth. Clients may change their card details at any time via their Tutorcruncher profile. Clients may opt out of the auto-charge process and request to pay for each lesson manually by emailing email@example.com to inform LinguaTute of this decision.
b. The price for lessons is stated on each individual language’s webpage on the Website. Any changes in these rates will be communicated to Clients a minimum of 21 days before taking effect.
6. Cancellation Policy for Tutoring
a. If a Client cancels with less than 24 hours’ notice before the Booked Services (lessons, events or other paid services with LinguaTute) were due to commence, or fails to attend the Booked Services without notifying the Tutor or emailing firstname.lastname@example.org, the Client will be obliged to pay for the lesson and the Tutor will receive full payment for the Booked Services.
b. If the Client cancels with more than 24 hours’ notice before the booked Services were due to commence, the Client will not be obliged to pay the fee and the Tutor will not receive payment for the Services.
c. The Client is entitled to one ‘free cancellation’ (i.e. when cancelling with less than 24 hours’ notice) every 4 months, to account for any emergencies, illnesses or other unforeseen circumstances that may affect the student’s capacity to attend a lesson.
a. If the Tutor cancels the booked Services with less than 24 hours’ notice, they will be obliged to pay a Late Cancellation Fee of £15, which will be docked from any outstanding payments owed to the Tutor.
b. If the Tutor cancels the booked Services with between 24-72 hours’ notice, they will not be required to pay a fee, provided they offer a suitable alternative date and time to the Client for the provision of the Services. If the Tutor fails to offer an alternative date and time, the Company reserves the right to charge the Tutor a Late Cancellation Fee.
c. If the Tutor cancels with more than 72 hours’ notice, the Company will accept their cancellation and the Tutor will not be required to pay a fee nor offer an alternative date and time for the provision of the Services.
d. If on more than one occasion the Tutor cancels the booked Services with less than 24 hours’ notice, or fails to attend the booked Services without notifying the Client, the Company reserves the right to terminate its relationship with the Tutor.
7. Termination of Tuition
Clients must provide 1 weeks’ notice in writing (if sent by email, this notice will be counted from the time of sending; if sent by post, it will be counted from 2 days after the notice was sent).
8. Changes To These Terms And Conditions
LinguaTute may change these terms and conditions by posting the revised version on the Website at least 14 days before they become effective. Please check the Website from time to time. Users will be bound by the revised terms and conditions if they continue to use the Website or the services following the effective date shown.
9. Governing Law and Jurisdiction
These terms and conditions and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with English law and the courts of England shall have exclusive jurisdiction to settle any such dispute or claim.
